Return of Goods
Ovation Landscaping shall not accept for return for credit any goods ordered from Ovation Landscaping incorrectly or subsequently found to be surplus to the customer’s requirements.
Ovation Landscaping shall endeavour to assist customers where possible by accepting at a reasonable restocking charge (minimum 25%) the return of goods providing it is within twenty-eight days of the original purchase (together with the original packing if applicable) which are from Ovation Landscaping normal stock lines but goods ordered from the manufacturer cannot be accepted without Ovation Landscaping prior agreement for the return and Ovation Landscaping restocking charges having been paid.

This Bulk Bag should contain a minimum of 800 kg, allowing for a +/-5% difference. The weight of the product within the bag will also vary depending on the moisture content of the product (i.e. wet sand weighs more than dry sand). The volume of the product within the bag will also vary depending on the weight of the aggregate within the bag.

Delivery Dates. All delivery Local or Nationwide is normally 3-4* working days. Confirmation of delivery dates (and supplying branch) are given by e-mail following the process of order through the payment gateway. Saturday delivery, local or by nationwide courier may carry a surcharge. Please email customer services for more information. * Add two Extra days for Bank Holidays. Also, some products are not carried at all branches. If delivery time is important please call Web sales prior to placing an order.
Delivery (a) The customer is obliged to inspect the goods on delivery or collection as the case may be. (b) When goods are offered for delivery to the site, Ovation Landscaping obligation is to deliver as near to the kerb side or site as a safe hard road permits. If a vehicle delivers or collects goods to or from a place off the public road, the customer shall be solely responsible for any accident or damage resulting. The customer shall provide free of charge any labour necessary for unloading goods when delivered, and Ovation Landscaping driver’s responsibility is limited to handling goods off the vehicle. If any Ovation Landscaping vehicle is kept on site for any unreasonable time or has to return to the depot without completing delivery through lack of assistance, or if additional staff have to accompany any Ovation Landscaping driver, an appropriate additional charge will be made. If the customer does not accept delivery of goods ordered for any reason, costs will be charged. (c) No liability is accepted for any loss arising from delay in delivery of goods unless Ovation Landscaping have expressly agreed to be bound by a delivery date of the contract’s essence. When delivery depends upon receipt of goods from the manufacturer, Ovation Landscaping do not accept responsibility for delay in such delivery unless Ovation Landscaping have obtained and reported to the customer acceptance by the manufacturer of the express condition as to time; but Ovation Landscaping will afford to the customer any remedy available to Ovation Landscaping against the manufacturer, but this shall be the limit of Ovation Landscaping liability. Ovation Landscaping accepts no responsibility for delay or non-delivery due directly or indirectly to strike, fire, act of state, force majeure, or other circumstances beyond its control. (d) If the customer wishes to claim that there is any shortage on delivery in respect of goods supplied by Ovation Landscaping, that the same have been damaged in transit or that any goods supplied by Ovation Landscaping are defective or not in accordance with the contract, then the customer shall give notice in writing to Ovation Landscaping and (in case of any shortage or damage in transit) to any carrier by whom the goods were delivered within three days after the date of delivery of the same. If the customer fails to give such notice or fails to give Ovation Landscaping the opportunity to inspect the entire consignment, the goods shall be deemed to have been delivered and to be in accordance with the contract in all respects, and therefore accepted by the customer. (e) If the customer or the customer’s consignee breaks bulk on delivery or unloads the whole or any part of a consignment of goods or materials the customer is deemed to have accepted delivery. (f) Ovation Landscaping may deliver the goods in one or more instalments, whereby each instalment shall be treated as a separate contract.
Local deliveries involving crossing drains, grating, pavements, drives or paths not constructed for the reception of heavy goods, or upon request placing goods over walls or fencing, are at the Buyer’s risk and the Buyer shall indemnify the Seller against all and any loss or damage sustained by the Sellers by reason thereof. Please fill out and return (via email) this form before delivery.
National Deliveries
Ovation Landscaping Deliveries are not made by our own vehicles, and so a third party is used – TPN or Palletforce. For any delays in Haulage that may occur, leading to customers incurring costs, Ovation Landscaping accepts no liability. We advise you only book in Landscapers / Tools / Hire Equipment / Labour once you are in full receipt of your goods. If you advance hire/book in labour and your delivery is delayed, Ovation Landscaping accepts no liability for any incurred cost.
If you decide to cancel the order due to delivery not being possible or for one of the reasons above, you will be entitled to a refund minus the cost of the delivery and the cost of returning the goods to us. A refund will only be provided minus these costs, within 14 days of the goods being back in our yard.
Deliveries are made to kerbside, and can only be moved up to a few metres from the back of the tail lift, although the driver will generally try to accommodate as much as possible.
Amendment: Delivery Charges & Fuel Surcharge (Effective 1st April)
Due to ongoing geopolitical instability in the Middle East and the resulting increase in global fuel costs, Ovation Landscaping reserves the right to revise its delivery pricing structure.
With effect from 1st April, the following changes will apply:
National delivery charges will increase to £115.20 (including VAT) per pallet.
These adjustments are necessary to reflect the significant and sustained rise in fuel costs impacting our logistics network. We will continue to monitor the situation closely and review these charges in line with market conditions.
Ovation Landscaping reserves the right to amend delivery charges and surcharges at any time in response to further changes in operating costs.
In the event of a missed delivery, the customer will incur a £50 redelivery charge.

Defective/Faulty Goods: (a) Subject to the customer’s compliance with all its obligations herein, goods supplied will be replaced or repaired free of charge, or in Ovation Landscaping absolute discretion the purchase price refunded if notice of the defect is given to Ovation Landscaping within 48 hours of receipt and the goods are returned to Ovation Landscaping depot carriage paid, and Ovation Landscaping are satisfied that the goods were defective in materials or workmanship on receipt. Ovation Landscaping accepts no liability for the cost of taking out, refixing or making good other materials. Subject to the above, Ovation Landscaping entire obligation and the customer’s sole remedies shall be in respect of: (i) Death or personal injury resulting from Ovation Landscaping negligence. (ii) Direct physical damage to the customer’s tangible property caused by Ovation Landscaping's negligence. (b) Ovation Landscaping total liability for all loss or damage which is claimed to result from any breach of Ovation Landscaping's obligations hereunder shall be limited to the customer’s actual money damages which shall not exceed the contract price for the goods (provided that the monetary limit shall not apply to Ovation Landscaping's liability for death and personal injury under (a) (i) above). (c) In no event shall Ovation Landscaping be liable for the loss or damage set out below even if foreseeable by Ovation Landscaping or in Ovation Landscaping's contemplation. i) Economic loss including loss of profits, business revenue, goodwill or anticipated savings; (ii) Damages in respect of special, indirect or consequential loss or damages. (iii) Any claim made against the customer by any other party.
